Terms of Use
Last updated: November 5, 2026
Please read these Terms before using this website. The Site is a collection of writings, recordings, and other creative work; use of the Site is subject to the conditions below.
1. Agreement to these terms
These Terms of Use (the “Terms”) govern access to and use of andrewmcavallo.com (the “Site”), operated by Andrew M. Cavallo (the “Operator”). By accessing, browsing, viewing, streaming from, or otherwise using the Site, you agree to be bound by these Terms and the Privacy Policy, to the maximum extent such agreement is recognized by applicable law. If you do not agree, do not use the Site. No provision of these Terms eliminates rights that cannot lawfully be waived.
2. Ownership; all rights reserved
Except for material expressly identified as belonging to others or in the public domain, all original content and elements of the Site—including musical compositions, lyrics, arrangements, performances, sound recordings, mixes, masters, videos, photographs, artwork, illustrations, stories, fictional settings and characters as expressed in protectable works, articles, books, scores, original text, graphics, and site design—are owned by the Operator or the applicable rightsholder and protected to the extent provided by copyright and other applicable laws. All rights are reserved. No license, transfer, waiver, assignment, or permission is implied by publication, visibility, streaming availability, linking, or access to the Site. References to or lawful quotations from third-party or public-domain works do not assert ownership of those works.
3. Special protection of musical compositions and recordings
The underlying musical composition (including applicable music and lyrics) and each sound recording embodying it are distinct protected works. Permission concerning one does not imply permission concerning the other. Streaming or previewing an audio or video file, or a browser offering the ability to save a file, does not grant permission to download, copy, reproduce, sample, rip, distribute, synchronize, remix, adapt, publicly perform, broadcast, re-upload, sell, sublicense, or otherwise exploit any music, performance, or recording. Such uses require the applicable rightsholder’s prior written permission unless independently permitted by law. The Operator expressly reserves all available rights and remedies, including those relating to unauthorized reproduction, distribution, derivative works, and removal or alteration of rights-management information.
4. Limited permission to view; prohibited uses
Subject to applicable law, you may use the Site solely to access and view its publicly available content through ordinary browser functionality for personal, lawful purposes. Except as expressly authorized in writing by the relevant rightsholder or permitted by law, you may not: (a) copy, reproduce, republish, distribute, sell, license, or commercially exploit Site content; (b) extract, scrape, harvest, bulk-download, mirror, or systematically archive Site content; (c) remove copyright notices, attribution, watermarks, or rights-management information; (d) circumvent access controls or technical restrictions, interfere with the Site, or misuse its resources; (e) use any music, recordings, performances, images, text, or other protected content to create, train, fine-tune, evaluate, populate, or enrich artificial-intelligence or machine-learning systems or datasets, or to generate imitations of protected performances, except where such restriction is prohibited by applicable law; or (f) falsely imply endorsement, authorization, or affiliation. Ordinary search-engine indexing and linking to publicly accessible pages are not prohibited by this paragraph when undertaken lawfully and without copying or using protected content beyond what the law permits.
5. Purchases and third-party services
Products linked from the Site may be sold or fulfilled through independent third parties, including Gumroad. Any purchase, payment, delivery, refund, license, or customer-service arrangement is governed by the terms applicable to that transaction and by mandatory law. Purchase of a copy does not itself transfer copyright or grant rights to redistribute, reproduce commercially, sample, publicly exploit, or sublicense the work. The Site may also display or link to content and services provided by other parties, including embedded media. Those parties operate independently and may impose their own terms and privacy practices. The Operator does not control or endorse third-party content or services merely by linking to or embedding them.
6. Information and availability; no warranties
The Site and its contents are provided “as is” and “as available,” without representations, conditions, guarantees, or warranties of any kind, express or implied, to the fullest extent permitted by law. To that extent, the Operator disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, noninfringement, uninterrupted availability, and freedom from errors or harmful components. Opinions, analysis, commentary, historical discussion, and other information are provided for general interest and do not constitute professional, legal, medical, financial, or other individualized advice. No obligation to maintain, update, correct, preserve, or continue any particular page, work, feature, or service is undertaken except where required by law.
7. Limitation of liability
To the fullest extent permitted by applicable law, the Operator and those acting on the Operator’s behalf will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages; lost revenue, profits, data, business, or goodwill; or claims arising from Site access, inability to access the Site, content reliance, unauthorized third-party conduct, service interruptions, linked services, downloads, or security incidents, regardless of the theory of liability and even if advised of the possibility of such damages. To the fullest extent permitted by law, aggregate liability arising out of or relating to use of the Site will not exceed the greater of US $100 or the amount, if any, paid directly to the Operator for use of the Site during the twelve months preceding the event giving rise to the claim. Nothing excludes or restricts liability that applicable law prohibits excluding or restricting.
8. Responsibility for misuse; indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Operator and the Operator’s agents and service providers from third-party claims, liabilities, losses, damages, and reasonable legal expenses resulting from your unlawful conduct, infringement of rights, or material violation of these Terms, except to the extent caused by conduct for which indemnification is prohibited by law.
9. Enforcement and reservations
The Operator may restrict or terminate access, remove material, or pursue available legal and equitable remedies for suspected infringement or misuse, subject to applicable law. Failure to enforce a provision on one occasion is not a waiver of the right to enforce it later. No provision limits the Operator’s rights or remedies under copyright, contract, tort, or other applicable law. Permissions or exceptions required by law remain unaffected.
10. Applicable law and disputes
Except where mandatory law requires otherwise, these Terms and disputes concerning the Site are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-laws rules; applicable federal law governs federal-law claims. To the extent legally enforceable, exclusive venue and jurisdiction for disputes concerning these Terms or the Site will lie in the state and federal courts located in Connecticut. Nothing in these Terms deprives any person of a forum, procedure, or remedy guaranteed by non-waivable law.
11. Changes; severability; entire agreement
The Operator may revise the Site, these Terms, or the Privacy Policy by posting an updated version; changes apply as permitted by law. If any provision is held unlawful or unenforceable, the remainder will remain in effect to the extent possible. These Terms govern use of the Site except where a separate written agreement or mandatory law controls. No provision creates a fiduciary relationship, partnership, duty to respond, or duty to provide ongoing services.
12. Contact
Questions about permissions or these Terms may be sent to [email protected]. Sending a message does not itself grant permission or create an obligation to respond.
